What is a Kerala Prohibited Property?

A property listed by the Registration Department under Pearl as not registrable — meaning no Sub-Registrar can accept a sale, gift, or mortgage deed against it. Prohibitions arise from court orders, Revenue Recovery proceedings, land reform restrictions, forest/CRZ classifications, government acquisitions, and other statutory bars.

What details are needed for a Prohibited Property search?

District, Taluk, Village, and Survey number with sub-division (or Block + LP) are the standard inputs. SRO, owner name, document number, or order reference help narrow the result.

What does the report contain?

Whether the property is in the current Prohibited list, the reason (court attachment, RR notice, land reform, forest, CRZ, acquisition), the order/notification reference, dates added and (if applicable) removed, the authority that placed the bar, and linked party names.

What happens if I buy a Prohibited Property?

The Sub-Registrar will refuse to register the sale deed. You'd be left with a sale agreement and consideration paid, but no transferable title. Recovery of money paid then becomes a civil dispute with the seller.

Common reasons a Kerala property is prohibited?

Court attachment, Revenue Recovery (RR) notice for unpaid dues, Kerala Land Reforms restrictions, tenant/kudikidappu lands, Reserved Forest overlap, CRZ restrictions, government Land Acquisition proceedings, escheat, and certain religious/Wakf-controlled properties.

Can a Prohibited Property be removed from the list?

Yes, on satisfaction of the underlying order — payment of dues clears an RR notice, settlement clears a court attachment, formal release / de-notification clears land-reform or forest entries. The Sub-Registrar updates Pearl once the release order is received.

Difference between Prohibited Property and Under Value Property?

Prohibited = cannot be registered at all. Under Value = was registered but the stamp duty paid is below the Government's guideline value, leading to supplementary stamp-duty demand on the buyer.

Does the EC catch a Prohibited Property?

Not directly. The EC shows transactions and mortgages registered against a property; the Prohibited list shows bars on future registration. Both checks are independent and necessary.

Are properties under court litigation always Prohibited?

Only if a court has specifically attached the property or restrained its sale. General litigation between parties may not result in a Prohibited entry until a specific order is passed. Always read the court order text.

How recent is the Pearl Prohibited list?

It is updated as orders are received from courts, Tahsildars, the Forest Department, and other authorities. Newer additions may take a few days to reflect. For high-value deals, run the check within a day or two of registration.
